Moving from the analysis of the recent judgement De Capitani v. Parliament (Case T-540/15 – 22 March 2018) in which the General Court condemned the EU legislative process for lack of transparency, the lecture will explore some unsolved aspects of participative democracy, paying particular attention to Regulation (EC) n. 1049/2001 on classified information, the work of trilogues within the legislative process as well as the implementation of  “transparency by design” among EU institutions and agencies.
